Welcome to African Beach Culture (ABC).
These Terms of Service (“Terms”) govern your use of our website [www.africanbeachculture.co.za] (“Site”), our online store, and any purchases or interactions with our brand.

By visiting our site and/or purchasing something from us, you agree to be bound by the following Terms. Please read them carefully.

We offer this website, including all information, tools, and services available from this site, to you conditioned upon your acceptance of all terms, conditions, and policies stated here.

If you do not agree with these Terms, please discontinue use of the Site.

  • We reserve the right to refuse service to anyone, for any reason, at any time.

  • You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or its content without written permission.

  • All products remain the property of African Beach Culture until full payment is received.

  • Any breach of these Terms may result in immediate termination of your services.

3️⃣. Accuracy, Completeness & Timeliness of Information

We strive to ensure all information on this Site is accurate and up to date. However, occasional errors may occur (e.g., typographical mistakes, pricing errors, or omissions).
We reserve the right to correct such errors, update information, or cancel orders if any details on the Site or related materials are inaccurate, at any time and without prior notice.

  • All products are subject to availability.

  • We reserve the right to discontinue or modify any product at any time without notice.

  • Prices are subject to change without notice but will not affect confirmed orders.

  • Product colours may appear differently on-screen due to lighting or display settings.

4.1. Product Care

Due to the nature of our products (including sunglasses and apparel), customers are responsible for following the provided care instructions.
Damage caused by misuse, neglect, or improper handling is not considered a manufacturing defect.

5️⃣. Pricing & Payment

  • All prices are listed in South African Rand (ZAR) and include VAT where applicable.

  • We accept payments through Shopify Payments, Paystack, Yoco, PayPal, and other listed methods.

  • Orders are only processed once full payment has been received and verified.

  • In the event of a pricing error, we reserve the right to cancel or refund any affected orders prior to dispatch.

6️⃣. Shipping & Delivery

Our Shipping Policy (available on our website) forms part of these Terms.

  • Orders are processed on business days (Monday–Friday).

  • Standard delivery within South Africa takes approximately 3–7 business days.

  • We ship via The Courier Guy, Fastway, and DHL.

  • International shipping is available via DHL Express (DDU — Delivered Duties Unpaid).

  • Delivery delays caused by courier backlogs, customs, or incorrect addresses are beyond our control.

7️⃣. Returns, Refunds & Exchanges

Our Refunds & Returns Policy forms part of these Terms.

We follow the Consumer Protection Act (CPA) and Electronic Communications & Transactions Act (ECTA) of South Africa.

  • Returns for defective or incorrect items are accepted within 6 months of purchase.

  • Returns for change of mind (online only) are accepted within 7 days if the product is unused, undamaged, and in its original packaging.

  • Sunglasses and headwear cannot be returned if worn, scratched, or damaged after delivery.

  • Refunds are processed to the original payment method within 5–10 business days after inspection and approval.

8️⃣. Accuracy of Billing & Account Information

You agree to provide current, complete, and accurate purchase and account information for all transactions made on our Site.
We reserve the right to cancel any order if we suspect fraud or unauthorised use of payment methods.

9️⃣. Optional Tools & Third-Party Services

We may provide access to third-party tools or integrations (such as courier tracking, payment gateways, or analytics).
We are not responsible for these services and you agree that they are provided “as is” without any warranties.
Please review each third party’s own terms and policies before engaging with them.

🔟. Personal Information & Privacy

Your submission of personal information through the store is governed by our Privacy Policy, in accordance with the Protection of Personal Information Act (POPIA).

We only collect necessary information to process orders, communicate with customers, and improve our services.
We will never sell or share your data with unauthorised third parties.

All content on this Site — including logos, text, designs, graphics, photography, and product imagery — is the property of African Beach Culture or its licensors.
You may not copy, reproduce, modify, or use any of this material without our express written consent.

To the fullest extent permitted by law, African Beach Culture shall not be liable for any:

  • Indirect, incidental, or consequential damages,

  • Loss of data or profits,

  • Damages resulting from the use of our products or services beyond our reasonable control.

If liability is found, it shall be limited to the value of the product purchased.

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
Any disputes will be resolved through the competent courts of South Africa.

We reserve the right to update, modify, or replace any part of these Terms at any time.
Updates will be posted on this page with a new “last updated” date. Continued use of the Site after such changes constitutes acceptance of the new Terms.
